Abstarct :
The importance of constitutional protection of intellectual property rights has emerged owing to the superiority of constitutional rules over all other laws, which obligates the legislator to abide by the controls and guarantees laid down by the constitution when regulating intellectual property rights. Thus, this study examined the adequacy and effectiveness of the Jordanian Constitutional protection of intellectual property rights in terms of the controls of their regulations and guarantees of protection compared to the Egyptian constitution by employing descriptive, analytical, and comparative methods. The research found that the Jordanian Constitution did not adequately regulate the protection of intellectual property rights. Importantly, the researchers demonstrated the need to provide explicit protection in the Jordanian Constitution for industrial property rights, and not only protect literary and artistic property rights, whereas the protection provided by the Egyptian Constitution should be extended to other industrial property rights in addition to inventors rights.
